[ParadiseAI] Terms of Service
These [ParadiseAI] Terms of Service (hereinafter referred to as "these Terms and Conditions") govern the use of all products and services (collectively referred to as the "Services") provided by [ParadiseAI] Company (hereinafter referred to as "[ParadiseAI]") to users of the service (referred to as "User").
1.1. "Content" means text, sound, music, images, videos, software, programs, computer code, and other information.
1.2. "Subject Content" means content accessible through the Services.
1.3. "Submitted Content" means content submitted, transmitted, or uploaded by Users on the Services.
1.4. "Separate Terms and Conditions" means terms and conditions separate from these Terms and Conditions, released or uploaded by [ParadiseAI] under names such as "Terms," "Guidelines," "Policies," etc., in connection with the Services.
1.5. "You" and "Your" refer to you as a User of the Services.
2.1. All Users shall use the Services in accordance with these Terms and Conditions. Users must agree to these Terms and Conditions before using the Services.
2.2. Minor users must obtain prior consent from a parent or legal guardian before using the Services.
2.3. If you use the Services on behalf of a company or other entity, "you" includes you and that entity, and you represent and warrant that: (a) you are an authorized representative of the entity with the authority to bind the entity to these Terms, and (b) you agree to these Terms on behalf of the entity.
2.4. These Terms contain an arbitration clause and a class action waiver. By agreeing to these Terms, you agree: (a) to resolve all disputes between us through binding individual arbitration, which means you waive any right to have those disputes decided by a judge or jury, and (b) you waive the right to participate in class actions, class arbitrations, or representative actions. You have the right to opt-out of arbitration, as described in detail below.
2.5. If the Services have Separate Terms and Conditions, Users shall comply with both the Separate Terms and Conditions and these Terms and Conditions when using the Services.
[ParadiseAI] may make necessary modifications to these Terms and Conditions within the scope of the purpose of the Services in accordance with relevant laws and regulations. After such modifications, [ParadiseAI] will indicate the content of the modified Terms and Conditions and their effective date within the Services or on the website, or notify Users by methods prescribed by [ParadiseAI].
The modified version of these Terms and Conditions shall become effective as of the effective date.
4.1. [ParadiseAI] attaches great importance to user privacy.
4.2. [ParadiseAI] will properly handle users' privacy information and personal data in accordance with the [ParadiseAI] Privacy Policy.
4.3. [ParadiseAI] commits to making every effort to adopt security measures to ensure the secure management of all information provided by users.
5.1. Users shall bear the responsibility and costs for personal computers, mobile phone devices, smartphones, and other communication equipment, operating systems, communication methods, and electricity required to use the Services.
5.2. You acknowledge that [ParadiseAI] may establish general practices and limits concerning the use of the Services, including but not limited to the maximum period that data or other content will be retained by the Services, and the maximum storage space that will be allotted on [ParadiseAI]'s servers on your behalf. You agree that [ParadiseAI] has no responsibility or liability for the deletion or failure to store any data or other content maintained or uploaded by the Services. You further acknowledge that [ParadiseAI] reserves the right to change these general practices and limits at any time, in its sole discretion, without prior notice.
5.3. [ParadiseAI] shall have the right to terminate the provision of all or part of the Services without prior notice to the User if any of the following circumstances occur:
(1) When performing system maintenance or repairs;
(2) When it becomes impossible to provide the Services due to force majeure factors such as accidents (fire, power outage, etc.), natural disasters, war, riots, labor disputes, etc.;
(3) When a system failure occurs or the system load becomes excessive;
(4) For the safety of the User or a third party, or in the event of an emergency for the public interest;
(5) In addition to the provisions of items (1) to (4) above, when [ParadiseAI] reasonably deems it necessary.
[ParadiseAI] reserves the right to post advertisements for [ParadiseAI] or third parties on the Services.
Certain services of [ParadiseAI] are paid services; specific prices, functions, and benefits are subject to the display on the page.
[ParadiseAI] supports completing transactions through multiple third-party payment service providers. Depending on the payment method you choose or your region, your transaction may be processed by different third-party payment service providers acting as the Merchant of Record.
When you complete a payment, the actual transactional relationship will be established between you and the corresponding payment service provider. This payment service provider will be responsible for order processing, billing, refunds (if applicable), and related tax compliance matters.
When using the relevant payment services, you also agree to be bound by the terms and policies of that payment service provider. The specifically applicable payment service provider is subject to the display on the actual payment page.
If you purchase [ParadiseAI] subscription services, it means you agree that:
- The subscription will automatically renew according to the agreed cycle (such as monthly or annually);
- The system will automatically deduct fees at the beginning of each billing cycle;
- If you need to cancel the subscription, you must complete the cancellation before the end of the current billing cycle;
- After cancellation, the service will stop after the current cycle ends.
Refund applications must meet the conditions and scope prescribed by this platform;
[ParadiseAI] supports completing transactions through multiple third-party payment service providers, and refund rules may vary across different payment methods;
Refunds will be processed in accordance with the relevant terms and policies of the payment service provider you actually used (acting as the Merchant of Record);
The specific applicable refund processing method is subject to the display of the actual payment channel and payment page;
[ParadiseAI] reserves the right to refuse refund applications that do not meet the criteria within a reasonable scope.
The Service or third parties may provide links or other access to other websites and resources on the Internet or third-party applications. [ParadiseAI] has no control over such websites, resources, or applications, and [ParadiseAI] is not responsible for and does not endorse such websites, resources, or applications. You further acknowledge and agree that [ParadiseAI] shall not be responsible or liable for any damage or loss caused by the use of or reliance on any content, events, goods, or services provided by such websites, resources, or applications.
11.1. [ParadiseAI] grants the User a non-transferable, non-sublicensable, non-exclusive license to use the Subject Content provided by [ParadiseAI], solely for the purpose of using the Services.
11.2. Users shall not use the Subject Content beyond the scope of the intended use of the Subject Content within the Services (including but not limited to acts such as reproduction, transmission, republication, modification, etc.).
11.3. If a User wishes to back up all or part of the Submitted Content, the User must perform the backup independently. [ParadiseAI] does not assume the obligation to back up any Submitted Content.
11.4. The Services may include features that allow multiple Users to edit content (posting, correcting, deleting, etc.). In such cases, the User who posts their Submitted Content shall grant other Users the right to edit such Submitted Content.
11.5. Users shall retain the rights to their Submitted Content, and [ParadiseAI] shall not acquire any such rights; however, among the Submitted Content, for those that are generally open to other Users (i.e., not limited to the User's "friends"), the User who posts such Submitted Content shall be deemed to have granted [ParadiseAI] a worldwide, perpetual, royalty-free license (including the right to modify (such as abbreviating) such content within the extent [ParadiseAI] deems necessary and appropriate, and the right to sublicense such usage rights to other third parties cooperating with [ParadiseAI]) to use such content for the Services and/or promotional purposes.
11.6. When [ParadiseAI] needs to confirm compliance with relevant laws and regulations or provisions such as these Terms and Conditions, [ParadiseAI] may check and confirm the content of User Submitted Content within the extent permitted by laws and regulations; however, [ParadiseAI] is under no obligation to perform such confirmation.
11.7. If [ParadiseAI] believes that a User has violated or may violate any applicable laws or regulations related to Submitted Content or the provisions of these Terms and Conditions, or if there is other reasonable necessity for [ParadiseAI]'s business, [ParadiseAI] reserves the right to block the User from using the Services in certain ways, such as deleting Submitted Content without providing prior notice to the User.
11.8. [ParadiseAI] AI-Generated Content Description
- The Services may contain content generated by artificial intelligence;
- Such content is for reference only and does not constitute any form of guarantee or commitment;
- Users shall bear full responsibility for the use, publication, or dissemination of such content;
- This platform has the right to review, restrict, or delete relevant content.
You are solely responsible for all content that you upload, post, publish, or display (hereinafter, "upload") or email or otherwise transmit via the Services. The following are examples of the kind of content and/or use that is illegal or prohibited by [ParadiseAI]. [ParadiseAI] reserves the right to investigate and take appropriate legal action against anyone who violates this provision, including without limitation, removing the offending content from the Services, suspending or terminating the account of such violators, and reporting you to the law enforcement authorities.
[ParadiseAI] prohibits Users from engaging in any of the following acts when using the Services:
12.1. Acts that violate laws and regulations, court judgments, resolutions or orders, or administrative measures that are legally binding;
12.2. Acts that may be in violation of public order, morals, or customs;
12.3. Use the Services to create malicious or abusive content (as determined by [ParadiseAI] in its sole discretion) or any content that violates [ParadiseAI] policies; or use the Services (or any part thereof or any technology contained therein) in any manner that infringes, misappropriates, or otherwise violates any person's intellectual property rights or other rights, such as copyrights, trademarks and patent rights, rights of reputation, privacy rights, and all other rights granted by law or by contracts entered into with [ParadiseAI] and/or third parties, or in a manner that violates any applicable law;
12.4. Upload or transmit any of the following content: (a) infringes any party's intellectual property or other proprietary rights; (b) you do not have a right to upload under any law or under contractual or other relationships; (c) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; (d) poses or creates a privacy or security risk to any person; (e) constitutes unsolicited or unauthorized advertising, promotional materials, commercial activities and/or sales, "junk mail," "chain letters," "pyramid schemes," "contests," "sweepstakes," or any other form of solicitation; (f) is unlawful, harmful, threatening, abusive, harassing, tortious, excessively violent, defamatory, vulgar, obscene, pornographic, libelous, invasive of another's privacy, racially, ethnically or otherwise objectionable; (g) in the sole judgment of [ParadiseAI], is objectionable or which restricts or inhibits any other person from using or enjoying the Services, or which may expose [ParadiseAI] or its users to any harm or liability of any type.
13.1. If any of the following circumstances exist or are likely to exist regarding a User, [ParadiseAI] may suspend the User's use of all or part of the Services, suspend or delete the account, terminate any agreement reached between the User and [ParadiseAI] regarding the Services (including but not limited to any agreement reached based on these Terms and Conditions, the same applies hereinafter), or take other measures that [ParadiseAI] reasonably deems necessary and appropriate, without prior notice to the User:
(1) The User violates relevant laws and regulations, these Terms and Conditions, or any Separate Terms and Conditions;
(2) The User is a member of an anti-social group or related personnel thereof;
(3) The User damages the reputation of [ParadiseAI] by spreading false information, using fraudulent means, coercive means, or other illegal means;
(4) The User is subject to attachment, provisional attachment, or application for auction; commencement of bankruptcy, civil rehabilitation, or similar proceedings; or [ParadiseAI] otherwise reasonably determines that there is uncertainty regarding the User's reputation;
(5) Due to reasons other than items (1) to (4) above, the relationship of trust with the User is lost, or [ParadiseAI] reasonably judges that it is inappropriate for [ParadiseAI] to provide Services to the User.
13.2. If the User's use of the Services (including but not limited to cases where [ParadiseAI] receives complaints from third parties due to the use of the Services) causes direct or indirect loss/damage to [ParadiseAI] (including but not limited to attorney fees), the User shall immediately compensate [ParadiseAI] for the loss/damage caused thereby in accordance with the requirements of laws and regulations and as requested by [ParadiseAI].
[ParadiseAI] does not provide any express or implied warranties regarding the Services (including Subject Content), including that there are no defects (including but not limited to faults, errors, vulnerabilities, or infringements related to security, etc.) or regarding safety, reliability, accuracy, completeness, effectiveness, and fitness for a particular purpose. [ParadiseAI] shall not be responsible for providing the Services to Users after removing such defects.
You expressly understand and agree that [ParadiseAI] shall not be liable for any indirect, incidental, special, consequential, exemplary damages, or loss of profits, including but not limited to loss of goodwill, loss of use, loss of data, or other intangible losses (even if [ParadiseAI] has been advised of the possibility of such damages), whether based on contract, tort, negligence, strict liability, or otherwise, resulting from: (a) the use or the inability to use the Service or any related information; (b) unauthorized access to or alteration of your transmissions or data; (c) statements or conduct of any third party (including Users) on the Service; or (d) any other matter relating to the Service. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you. If you are dissatisfied with any portion of the website or with these terms of use, your sole and exclusive remedy is to discontinue use of the Service.
If any provision of these Terms and Conditions violates any laws and regulations applicable to the agreement reached between the User and [ParadiseAI] regarding the Services, such provision shall not apply to the agreement with the User to the extent of such violation; however, the remaining provisions of these Terms and Conditions shall remain unaffected.
